1. Scope and provider

These Terms govern the use of Kasimir (kasimir.work, app.kasimir.work), provided by Deal Engine GmbH, Studio Babelsberg, Media Tech Hub Space, Haus 4, August-Bebel-Str. 26-53, 14482 Potsdam, Germany ("we"). Kasimir is offered exclusively to businesses and professionals (B2B), not to consumers within the meaning of § 13 BGB.

Conflicting terms of the customer do not apply unless we agree to them in writing.

2. The service

Kasimir is an AI marketing agent. It analyses data from accounts you connect, writes strategies and content calendars, generates presentations, videos, images and captions in your brand and publishes or schedules content on social networks you connect: after your approval, or automatically if you switch on fully automatic autopilot mode.

Features may change as we improve the service. During beta we provide Kasimir without a guaranteed availability. We announce material reductions of paid features in advance.

3. Accounts and workspaces

• You must provide accurate information and keep your login credentials confidential.
• You are responsible for everyone you invite into your workspaces and for their actions.
• You must be at least 18 years old and authorised to act for the business you register.

4. Connected accounts and platform rules

You may only connect accounts that you own or are authorised to manage. By connecting an account you instruct us to access it within the permissions you grant. Your use of each platform through Kasimir remains subject to that platform's terms and policies, including the Meta Platform Terms and Community Standards, the LinkedIn User Agreement and Professional Community Policies, TikTok's Terms of Service and Community Guidelines, Pinterest's Terms and Community Guidelines, the X Terms of Service and the Google Terms of Service. You can disconnect accounts at any time on the Connections page.

5. Your content and AI output

You keep all rights to the material you provide (brand assets, data, prompts) and to the output Kas generates for you. You grant us the rights necessary to process this material to provide the service.

AI-generated output can be inaccurate, incomplete or similar to content created for others. You are responsible for reviewing content before it is published and for everything published from your accounts, including claims, legal notices, rights in images, music and trademarks and labelling obligations for advertising or AI-generated content. If you enable fully automatic publishing, you accept that content is published without individual review.

6. Acceptable use

You must not use Kasimir to:

• publish unlawful, deceptive, defamatory, hateful, sexually explicit or infringing content, or spam;
• impersonate others or mislead about the origin of content;
• violate the terms of connected platforms, including rate limits and automation rules;
• collect personal data of third parties without a legal basis;
• attack, overload or reverse-engineer the service or circumvent its limits.

We may suspend publishing or accounts in case of a breach or a justified suspicion of one.

7. Fees

The beta is free unless agreed otherwise. Paid plans, prices and payment terms are agreed separately before they apply to you.

8. Data protection

We process personal data as described in our Privacy Policy. Where we process personal data on your behalf (for example data of your customers in connected accounts), we act as your processor; a data processing agreement under Art. 28 GDPR is available on request.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act.

For slight negligence we are liable only for breaches of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible and on which you may regularly rely), limited to the foreseeable damage typical for this type of contract. Otherwise liability for slight negligence is excluded. During a free beta, liability for slight negligence is excluded except for injury to life, body or health.

We are not liable for actions of connected platforms, such as removed posts, restricted reach or suspended accounts.

10. Term and termination

You can stop using Kasimir and request deletion of your account at any time. We can terminate free use with 14 days' notice and any use for good cause. After termination we delete your data as described in the data deletion instructions, except where we must keep it by law.

11. Changes to these terms

We may change these Terms with effect for the future. We inform you by email at least 30 days in advance; if you do not object within that period, the changes apply. We will point out this consequence in the notice.

12. Governing law and venue

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Exclusive place of jurisdiction for merchants and legal entities under public law is Potsdam, Germany.
